Welcome to Creatiflow

These Terms of Service ("Terms") govern your access to and use of Creatiflow's platform, services, and products. By accessing or using Creatiflow, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use our platform. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any modifications.

1. Definitions

  • "Platform" refers to the Creatiflow website, applications, and services
  • "Client" refers to learners using the platform to develop creativity and skills
  • "Facilitator" refers to educators who curate connections and guide learning experiences
  • "Expert" refers to practitioners who share expertise through sessions
  • "Enterprise" refers to organizations using Creatiflow for their teams
  • "User" refers to any person accessing or using the Platform
  • "Content" refers to text, images, videos, and other materials on the Platform

2. Eligibility

You must be at least 16 years old to use Creatiflow. By using our Platform, you represent and warrant that:

  • You are at least 16 years of age
  • You have the legal capacity to enter into binding contracts
  • You will provide accurate and complete registration information
  • You will maintain the security of your account credentials
  • You will comply with all applicable laws and regulations

3. Account Registration and Security

3.1 Account Creation

You must create an account to access most features. You are responsible for:

  • Providing accurate, current, and complete information
  • Maintaining and updating your account information
  • Keeping your password secure and confidential
  • Notifying us immediately of any unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

4. Subscription Plans and Payments

4.1 Subscription Tiers

Creatiflow offers multiple subscription tiers: Seedling, Bloom, and Flourish. Each tier includes different features and connection limits as described on our pricing page.

4.2 Payment Terms

  • Subscriptions are billed monthly or annually in advance
  • All fees are non-refundable except as required by law
  • Payments are processed securely through Stripe
  • You authorize us to charge your payment method for recurring fees
  • We may change prices with 30 days' notice

4.3 Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • You retain access to paid features until the end of the billing period
  • Refunds are generally not provided except as required by law

4.4 Facilitator and Expert Payments

Facilitators and Experts receive payment through Stripe Connect. Payment terms, schedules, and commission structures are defined in separate agreements and the platform's payment policies.

5. User Conduct and Responsibilities

5.1 Acceptable Use

You agree to use Creatiflow only for lawful purposes. You will NOT:

  • Violate any laws, regulations, or third-party rights
  • Harass, abuse, or harm other users
  • Share inappropriate, offensive, or illegal content
  • Impersonate others or misrepresent your identity
  • Attempt to gain unauthorized access to the Platform
  • Interfere with or disrupt the Platform's functionality
  • Use automated tools (bots, scrapers) without permission
  • Share your account credentials with others
  • Use the Platform for commercial purposes without authorization

5.2 Content Guidelines

You are responsible for content you create, upload, or share. Content must not:

  • Infringe intellectual property rights
  • Contain hate speech, discrimination, or harassment
  • Include explicit sexual content or nudity
  • Promote violence or illegal activities
  • Contain malware, viruses, or harmful code
  • Violate privacy or confidentiality

5.3 Professional Conduct

Facilitators and Experts must maintain professional standards, respect boundaries, honor scheduled sessions, and provide quality service consistent with platform expectations.

6. Intellectual Property Rights

6.1 Creatiflow's Intellectual Property

The Platform, including its design, features, code, trademarks, and content, is owned by Creatiflow and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

6.2 Your Content

You retain ownership of content you create. By posting content on Creatiflow, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Host, store, and display your content
  • Share your content with matched facilitators and experts
  • Use anonymized content for platform improvement
  • Create aggregated analytics and insights

6.3 Third-Party Content

The Platform may include links to third-party resources and content. We do not endorse or control third-party content and are not responsible for its accuracy or legality.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using Creatiflow, you consent to our data practices as described in the Privacy Policy.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • Merchantability, fitness for a particular purpose, and non-infringement
  • Uninterrupted, error-free, or secure operation
  • Accuracy, reliability, or completeness of content
  • Results or outcomes from using the Platform

We do not guarantee that the Platform will meet your requirements or that any defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATIFLOW AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage
  • Unauthorized access to or use of your account or content
  • Conduct or content of other users

OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Creatiflow and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: (a) your use of the Platform, (b) your violation of these Terms, (c) your violation of any rights of others, or (d) your content.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using account settings. Termination takes effect at the end of your current billing period.

11.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms or our policies
  • You engage in fraudulent or illegal activity
  • Your payment method fails or account is overdue
  • We cease operations or discontinue the Platform

11.3 Effect of Termination

Upon termination, your access to the Platform will cease, and we may delete your content. Provisions regarding intellectual property, disclaimers, liability, and indemnification survive termination.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@creatiflow.space to attempt informal resolution.

12.2 Binding Arbitration

Any dispute arising from these Terms or the Platform will be resolved through binding arbitration, except for:

  • Small claims court matters
  • Intellectual property disputes
  • Claims for injunctive relief

12.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions, class-wide arbitration, or representative actions.

13. General Provisions

13.1 Governing Law

These Terms are governed by the laws of the United States and the state in which Creatiflow is based, without regard to conflict of law principles.

13.2 Modifications

We may update these Terms at any time. We will notify you of material changes by email or platform notice. Continued use after changes constitutes acceptance.

13.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

13.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.

13.5 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Creatiflow regarding the Platform.
